Walker Wilcox Matousek LLP Secures Defense Verdict in Medical Negligence Trial in Cook County

Jeremy Kerman, Kassandra Altantulkhuur, and Danielle Towe successfully secured a defense verdict on behalf of their dialysis company client in a medical negligence case tried in the Circuit Court of Cook County, Illinois.

The lawsuit was brought by the estate of an 85-year-old decedent who passed away while a resident of a nursing home. The Estate alleged that both the nursing home and the dialysis provider failed to provide dialysis, failed to communicate, and failed to coordinate care, naming the nursing home, its management company, and the dialysis company as defendants. Throughout the trial, the dialysis company maintained that it could not treat the decedent because there was a policy in place for the nursing home to notify the dialysis company of the decedent’s arrival, and that the dialysis company was never notified that the decedent had been admitted to the nursing home.  The dialysis company also put on evidence that some of its employees contacted the nursing home about the decedent, and were told that the decedent had not yet been admitted. During closing arguments, Plaintiff’s counsel asked the jury to award $8 million in damages.

After a two-week trial before Judge Bridget Mitchell, the jury returned a $5.5 million verdict against the nursing home and its management company, but found no liability on part of the dialysis company.
