Walker Wilcox Wins $12M Coverage Dispute

Stephen Venable and Avniel Adler obtained a final summary judgment that their insurer client owed no duty to defend or indemnify an insured sued for defectively manufactured pipe joints for two gas pipelines, thereby saving the client $12 million in primary and excess policy limits. Although the insured sought reimbursement for its settlement of the underlying suit, Stephen and Avniel persuaded a Harris County District Court to find that the underlying settlement was not for covered “property damage” and that it did not fall outside of the policies’ business risk exclusions. The insured declined to appeal this ruling, thereby cementing this win for our client.
