Overview

Paul Matousek has over 35 years of experience representing U.S. and international insurers and others in matters involving directors and officers liability (D&O), other professional liability and errors and omissions (E&O), employment practices liability (EPL) and corporate indemnification. He has dealt with companies ranging from the Fortune 50 (including financial institutions) to privately-held to nonprofit, as well as major law firms and accounting firms.

Paul handles all aspects of claims and litigation assessment, management and resolution – with extensive experience in alternative dispute resolution – applying legal, practical and business considerations. He is regularly retained in connection with securities and ERISA class actions, shareholder derivative actions, regulatory and criminal proceedings, bankruptcy matters, complex business disputes and other high-exposure situations, along with related insurance coverage issues. For example, Paul has been involved with a number of major matters, including litigation concerning the credit and subprime mortgage crisis (e.g., Lehman Brothers, IndyMac), Madoff, options backdating, contingent commissions, initial public offering laddering, mutual funds market timing/late trading and antitrust issues, as well as litigation involving JDS Uniphase (a securities class action tried to verdict), Enron, Refco, KeyCorp, Boeing, Pfizer, Merck, Merrill Lynch, Wells Fargo, W.R. Grace, Intel, Baxter, CVS, Southern, RE/MAX, IMAX, Lucent, TXU, Honeywell, Bank of America, El Paso, Lockheed Martin, Royal Dutch Shell, Luca Operaton, MM&A, Thinkstream, FC Stone, GeoStar, Aquila and Synergy.

In addition, Paul consults on insurance risk analysis, underwriting issues and policy drafting.
